Getting Started

Independent contractor misclassification is perhaps the most difficult compliance issue that companies face today. With Congress, state legislators, federal and state agencies, unions, plaintiff’s attorneys, and other groups all focused on regulating independent contracting, the legal updates and risks are seemingly endless. While Navigator IC helps you take the guesswork out of this complex decision in a matter of minutes, it's imperative that you give your overall program careful consideration. The first step is to lay the groundwork for your Independent Contractor program.  Below are questions for your consideration.

  • How and when will Navigator IC fit into your contingent labor program?
  • Have you thought through the major elements of a program? This would typically include important topics like:
    • Decision making criteria to help managers select the right resource path (Employee vs. IC vs. contingent labor vs. outsource, etc.)
    • Policy and guidance on project scope, term length, and conditions
    • Approval process from HR (headcount), finance (budget), facilities (access), IT (access, provisioning, etc.)
    • Onboarding
      • Standard IC agreement
      • Standard SOW template to define the project, deliverables, timelines, rates, payment, etc.
      • Any required provisioning or access facilities/systems
      • I9 requirement and process
    • Method/systems for tracking of ICs
      • Headcount
      • Projects
      • Managing cost, rates, etc.
    • Project manager training for engaging ICs
      • Program policies and requirements
      • Project management do’s and don’ts
  • Who will manage the program internally?
    • Only individuals with access to the platform will see report results.
  • Who will complete the questionnaires?
  • Will evaluations be entered individually or in batches of up to 50?
  • Who will evaluate the report results and be responsible for taking any remediation steps with the contractor or their engagement?
  • Who will have final approval to engage contractors?
